These Terms of Use ("Terms") govern your use of the Headache & Migraine Diary app ("the App"), provided by Headache & Migraine Diary ("we," "us," or "our"). By using the App, you agree to these Terms. If you do not agree, do not use the App.

Use of the App

The App is intended for personal, informational use to help you track your headaches and migraines, identify patterns, and log potential triggers. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written permission.

Not Medical Advice

The App is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment. All information provided by the App is for informational purposes only and should not be used as a substitute for professional medical advice. Always consult a qualified healthcare provider for any health concerns or questions about your headaches or migraines. Do not disregard or delay seeking medical advice based on information from the App. The App is not intended to diagnose, treat, cure, or prevent any disease or health condition.

Subscriptions and Payments

The App offers free and paid subscription tiers. Free users have limited access to certain features. Paid subscriptions are processed by Apple through the App Store on iPhone and iPad, and by Google through Google Play on Android, and are subject to their terms and conditions. You can manage or cancel your subscription, and request refunds, in your App Store or Google Play account settings.

Data Storage

The App doesn’t require an account. Your headache logs, medications and settings are stored on your device. On iPhone and iPad, your headache logs and medications can also sync to your own iCloud account if iCloud is turned on, in which case Apple’s terms and privacy policy apply to that data. On Android, your data stays on your device unless your device backup includes it in your Google account. We don’t have access to this data and can’t restore it, so we are not responsible for data loss related to your device, iCloud account or Google account.

Third-Party Services

The App relies on third-party services, including the App Store, Google Play, RevenueCat for subscription management and, on iPhone and iPad, Apple iCloud for optional syncing. We are not responsible for the accuracy, availability, or reliability of third-party services, and service interruptions may occur. Your use of those services is also subject to their own terms.

Health Information Disclaimer

Headaches and migraines can have many causes, and individual needs vary. If you have concerns about your headaches, migraines, or any other health condition, please consult a healthcare provider. The App is a tracking tool and cannot detect or diagnose medical conditions.

Disclaimers

The App is provided "as is" without warranties of any kind. We do not guarantee that the App will be error-free, reliable, or available at all times.

Limitation of Liability

To the fullest extent permitted by law, Headache & Migraine Diary shall not be liable for any damages arising from the use or inability to use the App, including any damages resulting from health decisions or actions taken based on App information. You use the App at your own risk and should always consult healthcare professionals for medical concerns.

App Availability

We reserve the right to modify or discontinue the App at any time without notice.

Changes to These Terms

We may update these Terms occasionally. Continued use of the App after changes constitutes acceptance of the new Terms.
